Cancellation Policy:
We understand that life happens. Our cancellation policy reflects that. Most importantly we want to help a wonderful experience on your holiday. If you have to cancel a tour for any reason give us a call or send along an email and we will help. Our tours involve a number of behind the scenes expenses including hotel reservations, guides, bike rentals, luggage transfers and other logistics involved. We ask for a 25% deposit on our tours when you book with the final payment due 60 days prior to the trip. We ask for 60 days notice on our tours to cancel. If you cancel 61 days or more before the tour we issue a full refund. Within 60 days of departure all tours are non refundable. Our custom tours are a little bit different. We still ask for a 25% deposit on our tours when you book with the final payment due 60 days prior to the trip. However, in the case of the custom trips this deposit is not refundable. In both cases it is again important to give us a call. We are people too and have had to cancel change and adjust things. It is never fun. We will always work with you even within the 60 day window to transfer to a different tour, sort out a partial refund if we can recoup costs by rebooking or with flexibility from the hotels and so forth. Again, The goal is to have a wonderful experience on holiday. Gift Cards and Gift Certificates are non refundable. Thank you for trusting us with your travels.
Liability Waiver:
Thank you for joining us on a bicycle and beer tasting adventure through Beer & Bike Tours, LLC. We have a lot
of exciting stops planned for you on this trip. As you know, this tour requires that you are able to operate a
bicycle and enjoy trying craft brews. We are excited to have you join us!
Before we get started, our lawyer requires us to inform you of a few conditions to your participation in the tour
and we will ask that you sign and return a copy of this agreement to us before you begin your ride.
To participate in the tour, you must be at least 18 years of age (or accompanied by a parent) and have a valid
passport (or other acceptable identification). We will not be responsible if you do not have appropriate
travel documentation, including a passport, and we will not offer any refunds or reimbursement to you if
you are unable to participate in the tour because you do not have appropriate travel documents.
Riding a bicycle requires focus, concentration and a certain level of physical conditioning. We will be riding
on roads with vehicle traffic and it is important that you pay attention and watch for on-coming traffic,
particularly at intersections and road crossings. In addition, we may be traversing terrain that challenges
your physical abilities and it is your responsibility to notify our guides if you do not have the physical
conditioning to continue on the tour. You assume all risks associated with riding a bicycle on the tour.
We require that our guests wear helmets when riding their bicycles and obey all traffic laws, generally
accepted rules of safety and behavior (both on and off the bicycle) and the guidance and direction of our
guides.
You are responsible for the equipment that we supply to you, including a bicycle and helmet. If any of these
items are lost, stolen or damaged, while in your possession, you agree to reimburse Beer and Bike Tours the
full replacement value for a lost or stolen item or the cost of repair for a damaged item.
We will be stopping at breweries to sample their craft beer offerings. You must be 21 years old to sample
beer at all of the stops. Please be sure to have appropriate identification with you as you may be carded at
these facilities. Beer and Bike Tours does not monitor or oversee how much you drink at our stops. You are
responsible for ensuring that you remain able to continue to operate your bicycle safely and in compliance
with all applicable traffic laws. Please note, in many states, you can be arrested for operating a bicycle while
under the influence of alcohol. You are solely responsible for any problems, fines, accidents, injuries,
damage to yourself or the property of others, including Beer and Bike Tours, resulting from riding a bicycle,
consuming alcohol or otherwise participating in the tour and you agree to indemnify Beer and Bike Tours
from any such problems, fines, accidents, injuries or damage.
We or other guests may take photographs or videos of you during the tour and we may post these pictures
through the internet or on social media, circulate them by email or use them in our marketing materials or
otherwise distribute them in connection with promoting our business. We will not compensate you for these
photographs or videos. We may ask for copies of photographs or videos that you have taken during the
tour. We will not compensate you for these photographs or videos either.
Your enjoyment and the enjoyment of our other guests are paramount for Beer and Bike Tours. So, if you are
disruptive, unruly, are unable to participate in the tour, or are detracting from the enjoyment of our other
guests, we may remove you from the tour or determinate that you may not participate in the tour. These
decisions will be made in our sole discretion and you will not be entitled to reimbursement or a refund ofthe tour price. In addition, if you are on a multi-day tour, Beer and Bike Tours may make route changes,
hotel changes or other tour modifications as are required or desirable to improve the quality of our tour or
otherwise accommodate the comfort, well-being and needs of our guests.
Beer and Bike Tours, LLC Participant Agreement
I understand that it is a condition to my participation in a tour with Beer and Bike Tours, LLC (“Beer and Bike
Tours”) that I entered into this Participant Agreement (the “Agreement”). Accordingly, I acknowledge that I
have read and understand the other conditions to my participation in the tour as set forth above and on the
reverse side of this Agreement (the “Terms and Conditions”), all of which are incorporated into this Agreement
and are enforceable against me. I further agree to be bound by those Terms and Conditions and understand that
Beer and Bike Tours has no liability for any personal injury or property damage that may occur as a result of my
participation in the Tour. I further consent to the use of my likeness in any photograph, video, images or other
media taken during the Tour, without compensation of any kind. I agree I will be solely responsible for (i) my
health and safety; and (ii) the condition and adequacy of my bicycle and riding equipment. I will ride safely
within the limits of my own abilities, my equipment and the riding conditions.
I HEREBY FOREVER IRREVOCABLY RELEASE, WAIVE, DISCHARGE, COVENANT NOT TO SUE AND
AGREE TO HOLD HARMLESS BEER AND BIKE TOURS, LLC, ITS OFFICERS, MEMBERS, AGENTS,
CONTRACTORS, GUIDES, VOLUNTEERS and their respective successors and assigns (“B&B Parties”) from
any and all lawsuits, claims, damages, losses, liabilities, costs, personal injury or property damage or death
(collectively, “Losses”) I may suffer or incur directly or indirectly arising out of or relating in any respect to my
attending or participating in a tour or any activities, travel, products or services provided by the B& B Parties in
connection with a tour, regardless of the cause of such Losses. This waiver and release shall include, without
limitation, any Losses which may be (a) caused by any act, or failure to act, by the B&B Parties even if any
Losses result from the negligence of any or all of the B&B Parties; or (b) sustained by me before, during or after
the tour. I understand that this means that the B&B Parties are not liable to me for anything that might occur on
the tour, even if my Losses are caused by the negligence of the B&B Parties and even though those Losses are
not yet known to me and I acknowledge and agree to this release of claims. I further agree to indemnify, defend
and hold harmless the B&B Parties and each one of them, for all Losses, including, without limitation,
reasonable attorneys’ fees and costs, with the B&B Parties may sustain arising from or relating in any respect to
my participation in the Tour or my breach of this Agreement. I understand that this means that I will have to
reimburse the B&B Parties for Losses they incur because of my actions, including my own negligence, in
participating in the tour and I acknowledge and agree to this indemnification. This Agreement is legally binding
upon me personally, all members of my family and all minors traveling with me, my and their heirs, successors,
assigns, and legal representatives, it being my intention fully to assume all the risks associated with this tour
and to release and hold harmless the B&B Parties from any and all liabilities and Losses.
This Agreement is governed by the laws of the State of Colorado without reference to its conflict of laws
principles. Any disputes between Beer and Bike Tours and me regarding this Agreement, the tours for which I
was a participant or any event occurring in connection with those tours will be brought in the Colorado state or
federal courts, located in the City and County of Denver, Colorado and I consent to personal jurisdiction of
these courts. This Agreement shall survive indefinitely and shall govern my relationship with Beer and Bike
Tours on all tours for which I am a participant, even if a tour was cancelled or I was removed from a tour or if
the tour is before or after the date I signed this Agreement. This Agreementis the complete understanding
between Beer and Bike Tours and me regarding my participation in tours and supersedes any prior agreements
and communications (both written and oral) between us, except for any Participant Agreement that I may have
signed on an earlier tour, which agreement continues to survive in accordance with its terms. This Agreement
may not be amended except in writing signed by both Beer and Bike Tours and me. I have executed this
Agreement on the date set forth below and if I have executed this Agreement electronically or by use of an
electronic signature, it shall be of the same force and effect as if I signed this Agreement on paper.
I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS AGREEMENT AND
UNDERSTAND THAT I AM WAIVING ALL RIGHTS I MAY HAVE AGAINST BEER & BIKE TOURS, LLC AS
FURTHER DESCRIBED ABOVE.
